The Compliance Manager oversees Compliance Officers and their activities related to tax receivables, debt management, and enforcement while ensuring excellent service and managing HR matters.

 

JOB PURPOSE

To plan, coordinate, and manage the activities of Compliance Officers charged with the responsibility of collecting, non-filing and enforcement of accounts receivable within the geographical environment assigned to the particular Tax Office and resolve the most complex tax delinquency cases whilst ensuring advisory services are provided to internal/external clients.

KEY RESPONSIBILITY AREAS

Management and Administrative Duties

  • Provides leadership, support and guidance to the staff to ensure the Unit is effectively managed;
  • Assist with the development of the Operation and Work Plans with the supporting budget for the unit ensuring that all the relevant activities to be under taken and required resources are considered;
  • Plans, coordinates and directs all the activities of the functional area;
  • Manages and monitors the performance of the Unit;
  • Prepares and submits the monthly Performance Reports;
  • Enforces the standards and rules of professional conduct for staff within the Unit in order to maintain the highest degree of confidence in its integrity and efficiency;
  • Ensures staff is aware of and operates in accordance with the relevant laws, policies;
  • Develops and maintains effective working relations with external and internal stakeholders ensuring that the unit provides a consistently high level of service;

 

Technical and Professional Duties

  • Supervises the monitoring of Taxpayer Accounts in order to identify and prevent delinquency;
  • Evaluates complex cases and recommendations made by team members, assessing risks involved and possible implications in order to take action and resolve problems and complaints from clients;
  • Reviews and approves “write –off” submissions within the specified limits and recommends other large dollar accounts for write-off to the Senior Manager;
  • Evaluates the quality of work generated by team members with respect to consistent enforcement of various Acts and regulations administered by TAJ;
  • Analyzes complex cases referred by team members and suggest an approach to assist them develop their skills and resolves the most difficult cases;
  • Clarifies and interprets Acts, Regulations, policy directives and guidelines related to applicable programmes such as the collection and enforcement of accounts receivable and filing requirements;
  • Provides information to clients and /or their representatives to ensure that they are fully aware of their rights, entitlement and obligations;
  • Negotiates with clients and/or their representatives on high profile or complex cases to ensure departmental decisions are fair and consistent;
  • Recommends or approves payment arrangements for tax liabilities;
  • Monitors collection and non-filing activities performed by team members to ensure that all procedures are appropriately followed and actions are taken in a timely manner;
  • Selects samples of Taxpayers’ Accounts and conducts weekly reviews;
  • Recommends/approves legal actions such as seizure of assets, garnishments, summonses in non-filing situations and best judgment assessments to achieve compliance;
  • Monitors the following actions performed by supervisees;
    • Levy warrant/writ execution;
    • Court duties;
    • Identifying taxpayers who do not respond to notices/make payments;
    • Preparing summons for taxpayers;
    • Preparing judgement order after the court makes an order to pay in the absence of a taxpayer;
    • Preparing warrant of distress for the court’s signature if taxpayer does not respond to judgement order;
    • Taking steps for a Warrant of Commitment to be issued by the court if taxpayer defaults on judgement order;
    • Maintenance of all high priority case files.
  • Identifies and assists in developing cases for litigation;
  • Testifies as an expert witness for the Government, gathers relevant witnesses or documentary evidence to support the Government’s position;
  • Reviews and assesses programme results obtained by the team and recommends changes as necessary to enhance effectiveness of compliance activities;
  • Prepares and submits reports;
  • Identifies, monitors and escalates high priority issues from the front line, including emerging risks, to the relevant authorities.
  • Updates and submits the Enterprise Risk Management (ERM) Sub-risk Register for the Unit;
  • Performs any other duties assigned by Senior Manager.

 

Human Resource Management Duties

  • Develops and manages the Unit’s HR plan that addresses staff requirements and succession planning and liaises with the Senior Manager;
  • Participates in the recruitment of staff for the unit and ensures that they are aware of and adhere to the policies and procedures of the Department;
  • Conducts reviews of supervisees in accordance with the Work Plan;
  • Manages Leave Administration for staff as it relates to Casual, Sick and Vacation Leave;
  • Completes final performance assessments and recommends appropriate training and development programmes as necessary;
  • Initiates and participates in disciplinary proceedings relating to staff members within the unit and implements corrective measures.

 

 

PERFORMANCE STANDARDS

This job is satisfactorily performed when:

  • The Operational and Work Plans with the supporting budget are prepared as directed and submitted by the due date;
  • The revenue is collected and lodged daily, in accordance with the FAA Act and other financial guidelines;
  • The “write-off “of debt is appropriately managed in accordance with the relevant regulations and guidelines;
  • The most appropriate enforcement actions are taken for all the cases identified;
  • The activities of team members are planned and organized in sync with the Operational and Work Plans and are constantly monitored;
  • The complex cases are undertaken and effectively resolved;
  • Human resource policies and procedures are administered equitably and without discrimination in according to established policies;
  • Reports prepared and submitted in keeping with established standard and agreed timelines.

 

AUTHORITY TO:

  • Recommend and execute enforcement actions on taxpayers who fail or refuse to comply with tax laws and regulations;
  • Contact taxpayers/accountant;
  • Approve debt write-off;
  • Recommend amendments to operational procedures.

 

REQUIRED COMPETENCIES

  1. Specific Knowledge
    • Excellent knowledge of all the relevant tax laws, regulations and guidelines;
    • Excellent knowledge of the Financial Administration and Audit (FAA) Act and other financial regulations and guidelines;
    • Excellent knowledge of Tax Administration Jamaica’s operations and functions;
    • Excellent knowledge of management principles, practises and procedures;
    • Sound knowledge of standard business operations and commercial practices;
    • Working knowledge of computer systems and the relevant applications.

  1. Qualifications and Experiences
    • BSc. Degree in Business Administration, Financial Management or Accounting or equivalent qualification;
    • TARA certification would be an asset;
    • At least four (4) years experience in a related field.

 

WORKING CONDITIONS

  • Normal office environment;
  • Expected to work outside the normal working hours;
  • Travel (40%).
